Waiver and Release
There is inherent risk in engaging in any level of physical activity. By signing and entering into this Membership Agreement, You (herein "Member") acknowledge and agree to certain conditions of training at this Academy. Brazilian Jiu Jitsu is a physical activity as well as a sport and a way of life. Member acknowledges that the best way to learn and experience Brazilian Jiu Jitsu is by active participation in the classes offered at the Academy. Member further acknowledges that there is inherent risk of injury, up to and including death, in any physical activity that instructs a Member to defend him/herself from a physical attack or an attack by an opponent in training or any other contest. Member agrees to hold this Academy, its instructors, affiliates, employees, agents, assigns, and other Members harmless for any injury or illness incurred during training sessions at this Academy. "Training sessions" may include, but are not limited to, calisthenics and stretching for warm-ups, learning and drilling techniques with varying levels of complexity, including live sparring against an opponent Member of the Academy. Member further agrees that they will be voluntarily using facilities provided by the Academy to further training including, but not limited to: dressing rooms, restrooms, mat rooms, heavy bags, exercise equipment, office, pro-shop, sidewalk, and parking area. Member agrees to assume all risk of injury or contraction of any illness or medical condition that might result from training at the Academy as well as any damage, loss, or theft of personal property. This waiver and release of all liability includes, without limitation, injuries which may occur as a result of: (a) Member use of any facility or its improper maintenance, (b) Member use of any equipment which may malfunction or break, (c) improper maintenance of any equipment by Academy, (d) negligent instruction or supervision by Academy, (e) Member slipping and falling while in any Academy or on the surrounding premises, (f) first aid, emergency treatment or any other services which are negligently rendered or failed to be rendered by released parties, emergency personnel or Good Samaritans, or the Academy negligently preventing a Good Samaritan from rendering first aid.
YOU ACKNOWLEDGE THAT YOU HAVE CAREFULLY READ THIS WAIVER AND RELEASE AND
FULLY UNDERSTAND THAT IT IS A RELEASE OF ALL LIABILITY IN ADDITION, YOU HEREBY
WAIVE ANY RIGHT THAT YOU MAY HAVE, BY YOU ON BEHALF OF YOURSELF, YOUR SPOUSE OR ANY CHILD (MINOR OR OTHERWISE), TO BRING LEGAL ACTION OR ASSERT A CLAIM FOR INJURY OR LOSS OF ANY KIND AGAINST THE ACADEMY FOR OUR NEGLIGENCE ARISING OUT OF OR RELATING TO PARTICIPATION BY YOU, YOUR SPOUSE OR CHILD IN ANY ACADEMY ACTIVITIES, OR USE OF THE EQUIPMENT, FACILITIES OR SERVICES PROVIDED BY THE ACADEMY, DESCRIBED IN THIS WAIVER AND RELEASE, OR ON ACCOUNT OF ANY ILLNESS OR ACCIDENT OR DAMAGE TO OR LOSS OF YOUR PERSONAL PROPERTY.
You agree to indemnify, defend and hold harmless the Academy, its affiliates, employees, agents, representatives, successors, assigns and others from claims, losses, damages, and causes from action to which they may be subjected arising from or relating to participation by Member, or the parent, spouse, child (minor or otherwise) or guest of Member in any of the activities, use of the facilities or services that we provide, as further described in this waiver and release. Such indemnification will relieve the Academy of the consequences of its own actions, inactions or negligence. You further agree to accept full responsibility for the cost of treatment for an injury to yourself, or any parent, spouse, child (minor or otherwise) or guest of Member.
Agreement to abide bv Academv Policies and Procedures
In an effort to maximize your learning experience at our Academy, as well as to promote the personal safety of all Members, you agree to follow all Academy Policies and Procedures as posted.
Members wishing to compete for Team Invincible will be welcome to do so. Those Members will be required to compete in a Gi with the Invincible Academy logo patch prominently displayed on the jacket and/or the pants. Patches will be made abundantly available at the pro-shop. Other requirements and Academy policies with regards to sponsorships are available upon request.
Further, to promote personal hygiene and cleanliness at the Academy, the Academy asks that you engage in frequent baths and or showers, keep finger and toe nails trimmed at all times so as to minimize harm to yourself and other members, wash and dry uniforms frequently, wear a t-shirt and/or rashguard underneath the uniform, and wear a clean uniform to class. Failure to abide by these basic guidelines may result in a verbal reprimand up to being asked to leave class until the violation is corrected for the safety of yourself and others.
Non-solicitation of Fellow Students Non-competition Clause
Invincible Academy wishes to create a relaxing, engaging, hassle free environment for our students. Therefore, no solicitation of fellow students for any reason, especially alternative martial arts training, will be allowed without the express consent of Professor Phillips.
You are entering into an agreement to receive unique and special training in Brazilian Jiu Jitsu. Professor Phillips has spent years learning, practicing, and refining his art, so that it might be taught to the masses. As such, this Academy places a very high value on the intellectual property of its instructors. By entering into this agreement to train at this Academy, you are agreeing to refrain from starting your own martial arts academy, using the techniques and curriculum developed and used by this Academy, within 20 miles of this Academy or one of its affiliates without the express written consent of Professor Phillips. Violation of this clause may result in your immediate expulsion from the Academy, as well as further legal action by the Academy to protect its intellectual property. This non-compete also covers those using Professor Phillips’ instructional DVDs for financial gain. This use of Professor Phillips’ intellectual property, even when properly purchased, will not be tolerated without the express written consent of Professor Phillips.
Intellectual Property of Invincible Academy
In addition to the Intellectual Property represented by the Invincible Academy curriculum, the Academy and its corporate alter egos maintain copyrights and trademarks on certain marks recognized, registered, and associated with Invincible Academy including the name Invincible Academy, Invincible Jiu Jitsu, the logos created by Professor Phillips and various other intellectual properties associated with Invincible Academy. By entering into this agreement, you are agreeing to refrain from appropriating any marks associated with the Academy and Invincible Jiu Jitsu for any purpose without the express written consent of Professor Phillips. Any violations of this policy, such as appropriating the 'Invincible Academy' mark or any of the logos associated with Invincible Academy for commercial purposes, be they merchandising, competing academy, published works, endorsements, or any other unauthorized appropriation are expressly prohibited. The Academy will protect its Intellectual Property to the greatest extent of the law.
VIOLATION OF ANY OF THE POLICIES ENUMERATED HERE AS WELL AS VIOLATION OF ANY OF THE POSTED RULES OF INVINCIBLE ACADEMY MAY RESULT IN A VERBAL OR WRITTEN WARNING, TRAINING PRIVILEGES BEING TEMPORARILY RESTRICTED, AND EXPULSION FROM THE ACADEMY DEPENDING ON THE SEVERITY OF THE OFFENSE.
Additional Training Terms and Conditions
1. Failure to attend class does not signify or imply notification to cancel this agreement. Student's failure to continue lessons during the notification or program period does not relieve the obligation to pay the remaining tuition balance in full. Student's failure to attend scheduled lessons relieves the obligation of the school to provide lessons after the program end date.
2. School administrators may make any modifications in the class schedule as deemed necessary. Such modification does not relieve the undersigned of their payment obligations under any circumstances.
3. School administrators may close the school on national holidays, for the purpose of special events, and a period not exceeding four weeks per year for necessary maintenance and other purposes without affecting scheduled tuition payments.
4. The tuition costs for martial arts program are based on a 4-week month or a 48-week year.
5. By entering into the agreement the undersigned grants the school permission to use photographs, videotapes, artwork or other likenesses of the student for marketing, trade, publishing or any other lawful purpose.
6. Full payment of tuition fees does not guarantee Belt certification by school administrators.
7. Membership is non-cancellable and non-transferable except as stated herein. Membership may be transferred to another person or member on a case-by-case basis with the ultimate authority vesting in the Academy Owners.
8. Undersigned authorizes the use of a disclosed e-mail address for billing purposes and acknowledges that e-mail text may include financial information pertaining to the membership.
