Liability Waiver
Potentially, training in the martial arts is a dangerous activity. Bumps, bruises, scrapes, scratches, and soreness are commonplace and most students will encounter this sort of minor injury from time to time in their training. More serious injuries are possible, but not limited to sprains, strains, twists, cramps, and injuries of similar magnitude and students can expect to encounter these injuries frequently. The possibility of more serious injury exists, including but not limited to fractured bones, fractured teeth, cauliflower ear, torn ligaments, though not all students encounter such serious injuries. There remains, despite safety precautions, the remote possibility of crippling or death, though this is certainly not expected in these martial arts classes. I understand the above statement of risk, and I understand the rights and responsibilities of students. I assume responsibility for my own safety ( or safety of my child), understanding and accepting the risks involved with martial arts training. Even if the instructor has informed me that no serious injuries have ever happened in this school or with any of the instructors, I understand that this does not mean that there is no possibility of harm. Therefore, in consideration for receiving martial arts instruction and training at RCJ Machado Jiu-Jitsu, I assume entire responsibility and liability for any claim or actions specifically including claims for negligence, based on or arising out of injuries, including death, to me or damages to or destruction of my property, sustained or alleged to have been sustained in connection with or to have arisen out of or incidental to any or all instruction, training or exercise performed pursuant to my martial arts studies at RCJ Machado Jiu-Jitsu and all instructors, staff, guests, students, landlords, management companies and any and all other parties liability including but not limited to ant claim based in whole or in part on negligence, against RCJ Machado Jiu-Jitsu.
Assumption of the Risk and Waiver of Liability Relating the Coronavirus/Covid-19
The novel coronavirus, COVID-19, has been declared a worldwide pandemic by the World Health Organization. COVID-19 is extremely contagious and is believed to spread mainly from person-to-person contact. As a result, federal, state, and local governments and federal and state health agencies recommend social distancing and have, in many locations, prohibited the congregation of groups of people.
Carlos Machado Jiu-Jitsu LLC (“the Club”) has put in place preventative measures to reduce the spread of COVID-19; however, the Club cannot guarantee that you or your child(ren) will not become infected with COVID-19. Further, attending the Club could increase your risk and your child(ren)’s risk of contracting COVID-19.
By signing this agreement, I acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that my child(ren) and I may be exposed to or infected by COVID-19 by attending the Club and that such exposure or infection may result in personal injury, illness, permanent disability, and death. I understand that the risk of becoming exposed to or infected by COVID-19 at the Club may result from the actions, omissions, or negligence of myself and others, including, but not limited to, Club employees, volunteers, and program participants and their families.
I voluntarily agree to assume all of the foregoing risks and accept sole responsibility for any injury to my child(ren) or myself (including, but not limited to, personal injury, disability, and death), illness, damage, loss, claim, liability, or expense, of any kind, that I or my child(ren) may experience or incur in connection with my child(ren)’s attendance at the Club or participation in Club programming (“Claims”). On my behalf, and on behalf of my children, I hereby release, covenant not to sue, discharge, and hold harmless the Club, its employees, agents, and representatives, of and from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto. I understand and agree that this release includes any Claims based on the actions, omissions, or negligence of the Club, its employees, agents, and representatives, whether a COVID-19 infection occurs before, during, or after participation in any Club program.
