In consideration for my attendance and participation in the martial arts training offered by Tx Black Belt Academy, their employees , and students. I, the student/parent, acknowledge the existence of certain inherent risks in this type of training and hereby agree to assume all risks. I further relieve the school, it’s management, assigned staff and fellow students from any liability resulting from loss, whether personal belongings or bodily injury. I also hereby state, that myself or my child is physically fit to take the prescribed course of instruction and do so of my own free will in exchange for an agreed upon fee.
TX BLACK BELT ACADEMY COVID-19 STUDENT TRAINING FORM
By Agreeing below, I acknowledge the following or myself or my below-identified minor child as applications (in either case, the student);
• I am voluntarily beginning, or returning, to train at TX Black Belt Academy (TXBBA) or am voluntarily allowing my child to begin, or return to train at TXBBA.
• I understand there is risk to me or my child of contact with or infection of the COVID-19 virus as a result of training at TXBBA and am assuming that rick for myself or behalf of my child.
• I have, or my child has, had no fever for at least three (3) days without taking medication to reduce fever during that time.
• I have, or my child has, had no respiratory symptoms (cough or shortness of breath) for at least three (3) days.
• I have, or my child has, not experienced any symptoms of COVID-19 in the last fourteen (14) days.
• I have, or my child has, not been exposed to a confirmed or suspected case of COVID-19 in the last fourteen (14) days.
• I have, or my child has, not visited any Level 3 Travel Health Notice Countries in the last fourteen (14) days.
• I will self-monitor or monitor my child and seek medical evaluation at the onset of any COVID-19 related symptoms.
• I will leave, or have my child leave, class immediately and notify TXBBA staff if I begin, or my child begins, to experience any COVID-19 related
symptoms.
• I will adhere to COVID-19 social distancing and other precautionary practices, or have my child do so, as directed by TXBBA.
By agreeing below, I am entering into the following WAIVER, RELEASE AND INDEMNIFICATION for myself or my child and my or my child’s heirs, executors, assigns and personal representatives, which is in addition to the waiver, release and indemnification to the TXBBA student contract signed by me:
I, ON MY OWN BEHALF OR ON BEHALF OF MY MINOR CHILD LISTED BELOW: KNOWINGLY AND VOLUNTARILY (1) RELEASE TX Black Belt Academy (TXBBA), AND EACH OF THEIR AFFILIATES AND THEIR RESPECTIVE EQUITY HOLDERS, DIRECTORS, MANAGERS, OFFICERS, EMPLOYEES, INSTRUCTORS, AGENTS AND REPRESENTATIVES (“TXBBA RELEASED PARTIES”) FROM, AND WAIVE, ANY AND ALL CLAIMS, CAUSES OF ACTION AND DAMAGES ARISING FROM OR RELATED TO MY OR MY MINOR CHILD’S PRESENCE, ATTENDANCE OR TRAINING AT TXBBA, INCLUDING BUT NOT LIMITED TO DEATH, INJURY OR ILLNESS AS A RESULT OF ANY CONTACT WITH OR INFECTION FROM THE COVID-19 VIRUS (“CLAIMS”), AND (2) AGREE TO AND SHALL INDEMNIFY, HOLD HARMLESS AND DEFEND THE TXBBA RELEASED PARTIES FROM SUCH CLAIMS. SUCH CLAIMS INCLUDE BUT ARE NOT LIMITED TO THE CLAIMS BROUGHT BY ME, MY MINOR CHILD OR A THIRD PARTY REGARDLESS OF WHETHER ANY TXBBA RELEASED PARTY IS A PARTY THERTO. SUCH CLAIMS ALSO INCLUDE BUT ARE NOT LIMITED TO THOSE CLAIMS BASED ON STATUE, CONTRACT, TORT OR OTHER THEORY OF LAW OR EQUITY, WHETHER ACTUAL OR PROSPECTIVE, KNOWN OR UNKNOW, FORESEEN OR UNFORESEEN, AND WHETHER OR NOT CAUSED BY OR ARISING IN WHOLE OR IN PART OF THE GROSS, COMPARATIVE, CONTRIBUTORY OR SOLE NEGLIGENCE OF ANY TXBBA RELEASED PARTY.
